Terms of Service for BULQ

These Terms of Service ("Terms") are a binding agreement between you and Pocket Power Labs ("we", "us", or "our") and govern your use of the BULQ mobile application ("BULQ", "the app") and any related services. By downloading, installing, or using BULQ, you agree to these Terms. If you do not agree, do not use the app.

Your use of BULQ is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use BULQ. By using the app, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. The service

BULQ is an Android workout-tracking app that lets you log workouts, exercises, sets, reps, and weights; track routines, training plans, personal records, body weight, and body measurements; and optionally back up your data to the cloud and write workouts and body weight to Android Health Connect. The core app works offline and on-device by default. We may add, change, or remove features at any time.

3. Health and fitness disclaimer

BULQ is a fitness-tracking tool, not a medical device or a provider of medical advice. The app, including any calculations, estimates, suggestions, or statistics it produces (such as one-rep-max estimates, volume figures, or personal records), is provided for general informational and fitness-tracking purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.

• Consult a qualified physician or healthcare professional before beginning, changing, or continuing any exercise program, especially if you have any medical condition, injury, or concern.
• Never disregard professional medical advice or delay seeking it because of something you read or recorded in BULQ.
• You are solely responsible for how you train and for using proper form, appropriate loads, and safe equipment. Stop and seek medical attention if you experience pain, dizziness, or other symptoms.
• You assume all risks associated with physical exercise. To the fullest extent permitted by law, we are not liable for any injury, loss, or damage arising from your training or your reliance on the app.

4. Your account

You can use the core features of BULQ without an account. Some features - such as cloud backup - require you to sign in with Google Sign-In. You are responsible for maintaining the security of the Google account you use and for all activity that occurs under your BULQ account. Notify us promptly if you believe your account has been compromised.

5. Your data and cloud backup

You own the workout, health, and profile data you create in BULQ. By enabling Cloud Backup, you grant us a limited license to store and transmit that data solely to provide the backup and restore features, as described in our Privacy Policy. We do not sell your data or use it for advertising.

You are responsible for maintaining your own copies of important data. While we take reasonable measures to operate cloud backup reliably, we do not guarantee that backups will be error-free or always available, and you should not rely on the app as your sole means of data storage.

You can delete your data at any time - instantly through the in-app Delete account & cloud data feature, through the web deletion page, or by emailing us. See the Privacy Policy for details.

6. Pro subscriptions and billing

BULQ's core features are free and ad-free. We may offer an optional paid tier ("Pro") that unlocks additional features. If you purchase Pro:

• Purchases and subscriptions are processed by Google Play and are subject to the Google Play Terms of Service. We do not receive or store your payment-card details.
• Subscriptions renew automatically for the same period and at the then-current price unless you cancel before the renewal date. You can manage or cancel a subscription at any time in your Google Play account settings.
• Cancelling stops future renewals; you keep Pro access through the end of the current paid period. Deleting your BULQ account does not cancel a Google Play subscription.
• Except where required by law or by Google Play's policies, payments are non-refundable. Refund requests are handled through Google Play.
• We may change Pro features or pricing; price changes apply to future billing periods and, where required, with advance notice and the opportunity to cancel.

7. Acceptable use

You agree not to:

• use the app for any unlawful purpose or in violation of these Terms;
• reverse engineer, decompile, or attempt to extract source code from the app, except to the extent this restriction is prohibited by law;
• interfere with, disrupt, or attempt to gain unauthorized access to the app, our servers, or our service providers' systems;
• resell, redistribute, or commercially exploit the app or its content without our permission.

8. Intellectual property

BULQ, including its software, design, logos, text, and graphics (excluding your own data), is owned by Pocket Power Labs and protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial purposes, subject to these Terms. No other rights are granted.

9. Third-party services

BULQ relies on third-party services to function, including Google (Sign-In and Google Play services), Supabase (authentication and cloud-backup storage), Sentry (anonymous crash diagnostics), and Android Health Connect. Your use of these services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

10. Disclaimer of warranties

The app is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components, or that any data, calculation, or result will be accurate or reliable. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, Pocket Power Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the app, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or USD 25. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Pocket Power Labs from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the app, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Termination

You may stop using BULQ at any time and may delete your account and data as described above. We may suspend or terminate your access to the app or its cloud services if you violate these Terms or if we discontinue the service. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above and, where appropriate, through an in-app notice. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws applicable at Pocket Power Labs' principal place of business, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
